| Field | Op | Value | Note |
|---|---|---|---|
review_type | require | ATCP_51_compliant_local_permit_or_no_permit_required | §93.90 declares livestock siting a matter of statewide concern. Political subdivisions may not disapprove a livestock facility unless (a) the site lacks ag zoning, (b) the facility is prohibited in the ag district, (c) it violates locally adopted setback/drainage/building code, or (d) for ≥500 animal-unit facilities, fails ATCP 51 state standards. |
conditional_use_permits_for_existing_expansion | waive | no_new_cup_for_existing_facility_expansion | §93.90 — a political subdivision may not enact a CUP requirement for expansion of a pre-existing livestock facility (with narrow 20%-threshold exceptions). |

Research notes
Strong substantive ceiling on local CAFO regulation. ATCP 51 standards (odor, runoff, waste storage, manure management) are the floor and effectively the ceiling for local ordinances. NR 243 WPDES permits handle the ≥1,000 AU CAFO water-quality permitting (federal Clean Water Act delegated to DNR). Local zoning that purports to ban CAFOs in ag districts is preempted to the extent of conflict. Federal conflict check enabled for NPDES coordination.
