Research notes

Strong substantive ceiling on local CAFO regulation. ATCP 51 standards (odor, runoff, waste storage, manure management) are the floor and effectively the ceiling for local ordinances. NR 243 WPDES permits handle the ≥1,000 AU CAFO water-quality permitting (federal Clean Water Act delegated to DNR). Local zoning that purports to ban CAFOs in ag districts is preempted to the extent of conflict. Federal conflict check enabled for NPDES coordination.
