Research notes
Not a zoning preemption. Funding-conditionality regime: HCR-administered PHC certification is a precondition for ~$650M of discretionary state programs. Certification pathways: (1) growth by permits — downstate 1%/1yr or 3%/3yr, upstate 0.33%/1yr or 1%/3yr; (2) adopt HCR Pro-Housing Resolution + housing plan. No state override, no private right of action, no appeals mechanism. Applications directly addressing housing development are carved out. As of Aug 9, 2024: 162 certified / 335 applying; current count subject to verification against HCR dashboard.
