Research notes
Statewide minimum erosion and sediment control. Administered by NC Sedimentation Control Commission; implemented by NC DEQ Division of Energy, Mineral, and Land Resources (DEMLR) Land Quality Section. Cities and counties may run delegated local programs (≈60 jurisdictions including Raleigh, Charlotte, Mecklenburg, Wake, Durham, Greensboro, Winston-Salem, Asheville, Wilmington). Delegated programs may be more stringent than state minimum. Trout waters (Western NC: Avery, Watauga, Ashe, Alleghany, etc.) get 25-ft undisturbed buffer. Coordinates with NPDES Construction Stormwater General Permit (NCG010000). Penalties up to $5,000/day per violation. Distinct from §143-214.5 watershed protection but commonly stacked.
