Research notes

KDHE administers the state CAFO program as the EPA-delegated authority for NPDES CAFO permits under 40 CFR 122.23. Kansas is a major CAFO state (beef cattle feedlots in western Kansas — Finney, Ford, Seward, Haskell, Grant counties; swine in southwest Kansas; dairy in eastern counties). The county ag-use exemption at K.S.A. 19-2921 does NOT shield CAFOs from KDHE permit requirements — separate state regulatory framework. Federal conflict check enabled because of EPA delegation and NPDES floor.
