review_type | require | kdhe_cafo_water_pollution_control_permit | Confined animal feeding operations at or above the animal-unit thresholds in K.A.R. 28-18a require a water-pollution-control permit from KDHE under K.S.A. 65-171d and the federal NPDES CAFO rule (40 CFR 122.23). |

Research notes
KDHE administers the state CAFO program as the EPA-delegated authority for NPDES CAFO permits under 40 CFR 122.23. Kansas is a major CAFO state (beef cattle feedlots in western Kansas — Finney, Ford, Seward, Haskell, Grant counties; swine in southwest Kansas; dairy in eastern counties). The county ag-use exemption at K.S.A. 19-2921 does NOT shield CAFOs from KDHE permit requirements — separate state regulatory framework. Federal conflict check enabled because of EPA delegation and NPDES floor.
