Research notes

Targeted, narrow preemption — classic 1980s-1990s non-discrimination-against-manufactured-housing statute. Does NOT preempt generally-applicable design standards, lot-size minimums, or setbacks that apply equally to site-built homes. Cities cannot have zoning text that categorically excludes HUD-Code units from SF districts; where legacy text does so, the text is void as applied. This is currently the only enacted statewide categorical zoning override in New Mexico.
