Research notes

The 'ag exemption' frequently cited in ND county permitting. Counties have no authority to zone existing farm structures or general farming/ranching uses out of unincorporated land — only CAFOs/feedlots are within county purview. Does NOT apply to municipal zoning within city limits or ETJ. Does NOT preempt local zoning of NEW non-farm structures even on ag parcels.
