Research notes

Dillon's Rule state — MS municipalities have no inherent zoning power; authority flows exclusively from §17-1. Counties zone unincorporated territory under §17-1-17 in parallel to municipal authority. Comprehensive-plan predicate is the primary judicial-review hook — see Barnes v. Bd. of Supervisors of DeSoto Cnty., 553 So.2d 508 (Miss. 1989) and Edwards v. Harrison Cnty. Bd. of Supervisors, 22 So.3d 268 (Miss. 2009). No statewide density floor, ADU mandate, IZ ban, or design-preemption has been enacted as of 2026-05-18 (see preemptions.md for 2024RS–2026RS legislative re-scan).
