Research notes

Per-parcel geographic predicate against IDEM-classified wetlands (Class I, II, III). State program covers wetlands NOT regulated under federal Clean Water Act §404 (post-Sackett v. EPA, this universe expanded). SB 389 (2021) substantially reduced state protection for Class I and exempted Class II wetlands smaller than ¼ acre. Federal conflict check enabled because federal jurisdiction floor (WOTUS) determines which wetlands fall to the state program.
