Zoning power for the unincorporated portions of Sussex County — includes most of the Delaware Beach corridor outside the incorporated beach towns (Rehoboth, Lewes, Dewey, Bethany, South Bethany, Fenwick, Millsboro). Sussex County Council adopts zoning (§4902); Planning & Zoning Commission recommends (§§4907–4910); Board of Adjustment (§§4917–4920). AR-1 (Agricultural Residential) is the default rural base district. Sussex has experienced the most aggressive residential growth in DE 2020–2026 and has been sued repeatedly over comp-plan consistency, but no state override has been added — OSPC plan-coordination pressure only.
